9 years ago, Stewart had not testified in the insider trading trial but this time round she took to the stand calm and at ease. She presented her testimony crisply and in calm cool, explaining that she had a contract with Macy’s to retail some categories of her products but not all of her merchandise.
Stewart’s 4 hour testimony covered intricate aspects about her brand including her retail deal with Kmart. The trial culminated out of a lawsuit Macy’s brought against Stewart’s J.C. Penney and Martha Stewart Living Omnimedia in 2012. Macy’s claimed that Stewart’s company had breached a contract with them by agreeing to provide the similar kind of merchandise she offered them to Penney’s.
Macy’s began retailing Stewart’s products which range from home décor, bath and bedding products in 2007. By 2009 when her contract had expired with Kmart Macy’s was the only retailer selling her products. In 2011 Ron Johnson, Penney’s then newly appointed chief executed wooed Stewart by devoting big sections of their stores to her merchandise.
